Terms of Service

Effective Date: June 30, 2026

These Terms of Service ("Agreement") govern your use of the Hestia mobile application and associated services (the "Service"). By downloading, installing, or using Hestia, you agree to be bound by these terms. If you do not agree to any part of this Agreement, you may not use the Service.

1. Acceptance of Terms

By accessing and using Hestia, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We may update these Terms from time to time; for material changes, we will provide notice (by email or in-app notification) and the revised Terms will become effective 30 days after they are posted, as described in Section 15. Your continued use of the Service following the effective date of revised Terms means that you accept and agree to the changes.

Hestia is a meal planning and grocery shopping assistance application that helps users:

Hestia is not a medical or nutritional advice service. Meal plans and recipes are suggestions only and should not replace professional nutritional or medical guidance.

3. Account Responsibilities

Account Creation

To use most features of Hestia, you must create an account with a valid email address. You are responsible for:

Age Requirements

You must be at least 13 years old to create an account and use Hestia. If you are under 13, a parent or guardian must complete the verifiable parental-consent flow before an account can be created for you. Where local law requires a higher age or additional consent for online services, you may use Hestia only with the required parent or guardian consent or through an adult account holder.

Account Suspension

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct.

4. Subscription & Pricing

Subscription

Hestia may offer paid subscriptions, trials, promotional offers, or other paid features. Pricing, billing provider, renewal period, trial terms, and any promotional offer are displayed at the time of purchase before you subscribe. You can cancel anytime through the account, app-store, or payment-provider settings that apply to your subscription. Cancellation stops future renewals and takes effect at the end of the current billing period unless the billing provider's rules say otherwise.

Billing

Subscriptions may be billed through an app store or other payment provider. If you subscribe through the Apple App Store, payment is charged to your Apple ID when you confirm the purchase. App Store subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the current period ends, and your account may be charged within the 24 hours before renewal. You can manage or cancel App Store subscriptions in your Apple account settings. If a free trial is offered, the full price may be charged when the trial ends unless you cancel first.

Refunds, cancellations, payment methods, invoices, trial eligibility, and promotional offers are governed by the billing provider used for the subscription. We may share limited transaction, entitlement, fraud-prevention, and app-usage information with the applicable billing provider to support refund, billing, or subscription-review requests.

Price Changes

We may change subscription prices with 30 days' notice. Existing subscribers will be notified by email and in-app notification. Continued use after the price change constitutes acceptance of the new price.

Hestia Rewards Program

Optional Enrollment

Hestia Rewards is an optional program. You must explicitly join before you can earn points; creating a Hestia account does not enroll you. You can use all core Hestia features (meal planning, shopping lists, price comparison, pantry tracking) without joining. You can leave the program at any time in Settings.

The Value Exchange

When you join Hestia Rewards, you can earn points by contributing eligible grocery information: uploading receipts, confirming or correcting receipt items, scanning products, reporting prices, and completing clearly disclosed Missions. In exchange for points, you authorize Hestia to use your eligible contributions to improve grocery prices for the Hestia community and to create verified price intelligence, sponsored-offer measurement, and aggregated market reporting for participating grocery brands, retailers, and research partners. Hestia may be paid for that market intelligence. This exchange is described in our Notice of Financial Incentive.

Points

Points cannot be purchased, have no cash value outside the program, and cannot be transferred between accounts. Reward amounts are deterministic and disclosed before you complete an action; there is no lottery, drawing, or element of chance. Points redeem only for grocery and physical-retail gift cards offered in the catalog; points can never be redeemed for Hestia subscriptions or other digital functionality. Redemption minimums and monthly caps are shown in the app. Points expire after 365 days of account inactivity; we will notify you 30 days before expiration.

Receipts and Verification

After an in-store shopping session we record, you can upload your receipt any time before you make your next plan to earn that trip's receipt reward. If you skip it, you simply miss that reward. We never deduct or claw back points you already earned. Submissions are verified before rewards are credited, and fraudulent submissions may result in denial of the related rewards or removal from the program.

Location Is Optional

You never need to enable Location Services to earn rewards. Sharing location can speed up verification of store-specific submissions, but every submission type has an equal manual-review path that pays the same reward.

Leaving the Program

If you leave Hestia Rewards, you stop earning new points and we stop using your future contributions commercially. You keep the points you already earned and may still redeem them; leaving does not forfeit earned value and does not shorten the expiration timeline described above.

Referral and Ambassador Programs

Standard Referrals

Hestia may offer referral rewards to users who invite new users with a valid referral link or code. Unless a specific promotion says otherwise, a standard referral reward is earned only after the referred user creates a new account, completes any free trial period, becomes a paying subscriber, and the first paid charge clears without refund, chargeback, fraud, or other disqualification.

Referral rewards may be issued as subscription credits, account credits, points, or another reward type described at the time of the offer. Self-referrals, duplicate accounts, fake accounts, spam, misleading promotion, existing accounts, test accounts, and referrals using the same household, device, payment, or other abuse signals may be denied or reversed. We may change, cap, pause, or end the standard referral program at any time.

Ambassador Program

The Hestia Ambassador Program is invitation-only. Ambassador terms are case-by-case and may include specific rates, payout caps, campaign windows, eligible subscription periods, payment methods, and other limits. No ambassador commission is earned during a referred user's free trial. Commissions are earned only on qualified paid subscription periods that meet the ambassador's current agreement and may remain pending until review, refund, chargeback, and fraud checks are complete.

We may change ambassador rates, caps, eligibility rules, payment methods, review windows, or program availability prospectively. We may pause, terminate, deny, reverse, or claw back commissions for prohibited conduct, refunds, chargebacks, fraud, misleading claims, failure to follow brand or disclosure rules, or violation of these Terms.

Ambassadors are responsible for any taxes arising from payments. Before cash payouts, we may require legal name, payout information, tax forms or tax status, identity checks, minimum payout thresholds, and other information needed for accounting, tax reporting, or payment processing. Paid ambassadors must clearly disclose their relationship with Hestia when promoting Hestia.

Rewards & Data Contributions

Hestia may offer optional rewards, missions, referrals, or data-contribution features. Rewards, if available, are promotional benefits subject to eligibility, caps, fraud review, provider availability, and the rules shown in the app or in separate program terms. Points, credits, or rewards are not bank deposits, stored value, wages, or legal currency; they may be redeemed only as expressly allowed by Hestia. We may change, cap, pause, or end any rewards or contribution program prospectively. The data we collect, how it is used and shared, your choices, and any required financial-incentive notice are described in our Privacy Policy.

5. Intellectual Property Rights

Hestia Content

All content in Hestia, including recipes, meal plans, design, graphics, logos, and text, is owned by or licensed to Hestia and protected by copyright and trademark laws. You may not reproduce, distribute, or transmit any content without our prior written consent.

AI-Generated Meal Plans

Meal plans generated by Hestia's planning system are created for your personal, non-commercial use. You may not republish or commercially exploit generated meal plans without written permission. Hestia retains the right to use aggregated, anonymized meal plan data for improvement of the service and research.

User License

We grant you a limited, non-exclusive, non-transferable license to use Hestia for your personal use only. You may not sublicense, sell, rent, lend, lease, transfer, assign, or otherwise dispose of the app or its content.

Prohibited Competitive and Automated Use

Except as expressly permitted in writing, you may not scrape, crawl, index, harvest, bulk download, copy, benchmark, monitor, reverse engineer, decompile, disassemble, or otherwise extract the Service, its content, data, prompts, workflows, pricing information, recipes, recommendations, outputs, user interface, or underlying logic for commercial use, model training, product development, competitive analysis, or to build or improve a competing service. You may not bypass rate limits, access controls, robots instructions, technical protections, or normal user interfaces, and you may not use bots, scripts, automated accounts, shared accounts, or other automated means to access the Service.

6. User-Generated Content

Custom Recipes

You may create and save custom recipes in Hestia. You retain ownership of your custom recipes. By uploading custom recipes, you grant Hestia a non-exclusive license to use, display, and analyze them to improve the service (in anonymized form).

Receipt & Document Uploads

Some features allow you to upload receipts, product images, pantry images, recipes, labels, notes, or other content for processing. You are responsible for the content you submit and must have the right to share it. Do not upload images that include other people, unrelated private documents, payment cards, government IDs, or sensitive information that is not needed for the feature. Hestia processes submitted content according to the Privacy Policy.

7. Disclaimers & Limitations

Not Medical or Nutritional Advice

Meal plans, recipes, Ember Scores, and dietary information provided through Hestia are for general informational and wellness purposes only. They are not medical or nutritional advice and are not a substitute for professional medical advice, diagnosis, or treatment. Hestia does not diagnose, treat, cure, or prevent any disease, and does not guarantee any health, nutritional, or weight outcome. Always consult a qualified healthcare provider before making decisions about your diet, nutrition, or health, especially if you have a medical condition, dietary restriction, or allergy. Individual results vary.

AI Suggestions Are Guidance Only

The AI-generated meal plans, price recommendations, recipe suggestions, image detections, nutrition estimates, product matches, and other automated outputs are suggestions based on available data. They may be incomplete, outdated, inaccurate, or unsuitable for your situation. You are responsible for reviewing outputs before relying on them.

Food Safety, Allergies, and Nutrition Estimates

You are solely responsible for confirming that any meal, ingredient, product, recipe, or shopping suggestion is safe and appropriate for you and anyone you cook for. Hestia cannot guarantee that a generated recipe, detected ingredient, product match, or third-party label is free from allergens, cross-contact, substitutions, mislabeling, or other errors. Always read product packaging, follow safe food-handling and cooking practices, and consult a qualified professional about allergies, intolerances, medical dietary needs, pregnancy, or other health conditions. Nutrition, calorie, macro, portion, and health-related estimates are approximations and should not be used for medical, clinical, emergency, or high-risk decisions.

Price Accuracy

Price comparisons and estimates are based on available data and may be inaccurate, outdated, or unavailable for your location. Actual prices may vary due to promotions, location, and retailer variations. We are not responsible for price discrepancies between quoted and actual prices at retail stores.

Savings, Offers, and Promotions

Any savings, budget, coupon, discount, reward, offer, or promotion shown in Hestia is an estimate or conditional offer, not a guarantee. Actual results depend on your choices, eligibility, location, retailer availability, promotions, taxes, fees, product substitutions, verification, and third-party terms. Retailers, payment providers, reward providers, and other partners may change, refuse, expire, or withdraw offers at any time.

Store Information

Store locator information may be incomplete or outdated. Hestia is not responsible for store hours, locations, or availability of products. Always verify store information directly with the retailer.

Third-Party Content

Hestia may display recipes and content from third-party sources. We do not endorse these sources and are not responsible for their accuracy or legality. Review original sources for licensing and attribution requirements.

"AS IS" Service

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Use of the Service is at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HESTIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

9. Termination

By You

You can delete your account anytime in Settings > Account > Delete Account. Upon deletion, your personal data will be removed according to our Privacy Policy.

We may terminate or suspend your account immediately without notice if you:

Effect of Termination

Upon termination, your right to use Hestia ceases immediately. You will not receive a refund for prepaid subscription fees unless legally required. Some sections of this Agreement survive termination (Disclaimers, Limitation of Liability, Governing Law).

10. Intellectual Property Infringement

If you believe Hestia infringes your intellectual property rights, contact us at support@hestiaember.com with:

11. Governing Law & Jurisdiction

Unless applicable consumer law requires otherwise, this Agreement is governed by the laws of the state where Hestia Labs LLC is organized, without regard to conflict-of-law rules. You agree to bring any legal action or proceeding arising from this Agreement in the courts with jurisdiction over that location, except where applicable law gives you the right to bring a claim elsewhere.

12. Dispute Resolution

Before pursuing legal action, both parties agree to attempt to resolve disputes informally through good-faith negotiation. If negotiation fails within 30 days, disputes may be escalated to mediation or arbitration as permitted by law. Some disputes (injunctive relief for IP infringement) may proceed directly to court.

13. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, that provision will be removed, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

This Agreement, along with our Privacy Policy, constitutes the entire agreement between you and Hestia regarding the use of the Service and supersedes all prior agreements and understandings.

15. Changes to Terms

We may update these Terms at any time. Changes will be effective 30 days after posting. Your continued use of Hestia after changes constitutes your acceptance of the updated Terms. For material changes, we'll notify you via email or in-app notification.
